28-May-2009

I am off to Salt lake City today for World Superbike at Miller Motorsports park and will try to post any updates as they come in.

For today here are some more comments I recieved by email, some are entertaining:

====================
WOW! I would never expect Audi to behave this way. Maybe because this is Audi Canada, but that should be a “non-issue” here. My Dad has an A8 for some time now (I believe he is on his second now), some other people have these cars for years too, and never heard such story, but that is in Europe, maybe this is the difenerece. I took liberty to forward to some of my friends here – you never know, maybe someone knows someone that could help.
I hope you chose your bikes better than cars now…LOL
BTW – ho’s going? Haven’t heard from you in some time.

27-May-2009

Been away up north in Fort McMurray for the last two days, have not heard anything from Audi or dealer again. I will follow up with the dealer next week when i am back from Salt Lake City next Tuesday.

On Monday I had a conversation with Christopher from Audi and he was not aware of the letter from Audi Canada explaining I had warranty. Seems like the warranty department doesn't know the rules that the service department is trying to force on me. He asked me to fax him the letter but I directed him to the blog, which he refused to visit, so I emailed him the link to the blog at audicare@audi.com.

Here are some well wishing emails I recieved:

Sorry to hear about this shit going down with Audi Ryan. I always thought Audi was a stand up respectable company and a car I would consider buying if I had the gold coins to do it. This changed my mind about Audi and what they are all about!

They are proving they are just another corporate giant trying to screw the little guy again after they taking your hard earned cash! What a bunch of tight ass excuse making a$$holes!

------------------

"Man, I'm steering clear of Audi after your experience. It's bad enough they can't do a proper ring seal, even worse that they've left you out to dry like they have. I hope you get it resolved to your satisfaction. Good luck with it Ryan."

New Excuse!

What is Covered - Cropped
Originally uploaded by homeychan
Audi just announced the newest excuse for denying warranty to the Alberta Arbitration & Mediation Society (www.aams.ab.ca)....
My car does not qualify for warranty because it is.....wait for it....an American car. Never mind it's registered in Canada and has been fully warrantied until this problem AND I have in my possession a letter from Audi Canada stating my warranty has been successfully transferred with a handbook explaining what is covered, which incidentally on page 5 (What is covered), first point states "Engine - block, pistons, connecting rods, crankshaft, oil pump...
We'll wait for the next one.

Received a document in the mail from Audi, that welcomes me to the CPO warranty program, this means my car is covered till 160,000 or 2011. I wonder what excuse they will have now for denying warranty.

Spoke to dealer this morning and it seems they have ordered a new short block at their expense; this is a $12k part! I am happy to be getting closer to driving my car again, but feel terrible for the dealer. Hopefully dealer is able to recover costs from Audi, sent them a copy of my CPO warranty letter.

The Dealer

My Dealer
This blog may seem anti Audi, but I want to comment on the outstanding job being done by my dealer so far. My dealer has been fantastic and if they sold another brand of car I would buy from them! The service guys are genuine and seem to do good work, I’ve heard some people refer to the dealer as “the stealer”, but not these guys. They have gone above and beyond on numerous occasions to date; in fact this has become a Ryan and Glenmore Audi against Audi Canada. Audi has denied me warranty because my dealer had “missed opportunities” and has pointed the finger squarely at the dealer. Problem I have with that thinking is the dealer did not build the faulty engine; all they have done is troubleshoot the issue, if the dealer misdiagnosed the problem, it doesn’t change the fact the car came off the line with a defect from Audi! So far the dealer has offered to pay for my stereo that was stolen out of my car and have provided me with a loaner; at least having them being reasonable has helped make this a little better. I will happily bring my car to the dealer for service if it ever runs again!

If the rest of Audi's dealer network is this good, I can understand how they stay in business, because it's certainly not a result of customer service from Corporate.

23-May-2009 Some Pictures

Here are some pictures of my car as it sits for the last 7 weeks. My dealer has been fantastic and very helpful, after my discussion with Audi yesterday it seems that it's me and the dealer against Audi. The comments on the phone about "missed opportunities" and "not normally throwing dealers under the bus" cover it perfectly. If someone could tell me what "missed opportunities" mean I would really appreciate it.

Letter to Audi from lawyer

Attention: Mediation/Arbitration Unit

Dear Sir:

RE: Ryan Fernandez’s Audi Repairs and Warranty

Please be advised that we have been retained by Ryan Fernandez in regard to this matter. Mr. Fernandez is the owner of a 2005 Audi S4 - Serial No: WAUPL68E55XXXXX, Description 05, S4, S4, 6SPD. This motor vehicle has been repaired and serviced at XXXX XXXXX, XX Rxxxxrd Way SW, Calgary, Alberta on sixteen (16) occasions between September 22, 2006 and February 11, 2009. Unfortunately, the car still continues to experience problems in relation to the oil consumption and related issues.

On September 22, 2006 our client first brought his car to XXXXX Audi, with 49,759 km on it and had the engine oil replaced by synthetic oil and had the filter changed. The car was returned to the dealership on December 11, 2006, at 51,994 km, because another oil and filter change was needed. Our client had to take his car into the dealership six times throughout 2007, due to oil consumption problems. In 2008, our client again had to take the vehicle into the dealership 6 times because of the high level of oil consumption of the car. In 2009 Mr. Fernandez has already had to bring his car in twice because of continued problems in relation to the oil consumption of the car.

On July 28, 2008 Mr. Fernandez brought his car into the dealership at 79,097 km in order to have the oil weighed as per Audi procedure to determine consumption and he was told that according to Audi’s policy he was to return to the dealership in 1000 km in order to have the oil drained and weighed again for comparison. He brought the car back on August 18, 2008 at 80,768 km in order

to have the oil consumption checked. The dealership drained and weighed the oil and found the car to be down 1.7 kgs of oil in 1700 km. At this time Mr. Fernandez was told that since his car is now over 80,000 km it is not covered by warranty. However, this problem did not arise at this time, the oil consumption problem was specifically brought to the attention of Gxxxxxe Audi on June 1, 2007 at 41,992 km and the owner has continued to try and deal with this problem while the vehicle was well within the range of warranty coverage.

In addition, the car has extended warranty coverage but Audi Canada has failed to allow our client to switch the warranty to the appropriate owner because Audi said they made changes to their policy on August 1, 2006 and the car was registered on August 31, 2006. Mr. Fernandez was proactive in this matter and tried to minimize the loss by having his vehicle covered under warranty, if not for Audi Canada’s refusal to cooperate the vehicle in question would still be covered by warranty.

It is our understanding that Gxxxxxe Audi has volunteered to re-ring the car at no expense to the owner; this repair would include both parts and labor. While we appreciate this offer in order to accept it we require the following:

Written authorization by Audi Canada that the owner will not be charged for any of the repairs that Gxxxxxe Audi offered to complete;
A written assurance by Audi Canada that if these repairs do not permanently solve the problem then Gxxxxxe Audi will continue to repair the car at no cost to the owner; and
That Audi Canada transfer the extended warranty, until 2011 or 160,000 km, documents to our client’s name;

ALTERNATIVE our client is prepared to accept another Audi of similar make, model and year, with the extended warranty coverage in exchange for his Audi.

We require the above in order to guarantee that this issue will continue to be attended to in a timely and efficient manner. If you have any questions in regards to the contents of this letter please advise our office.

We look forward to a speedy resolution to this issue.

Yours truly,

Called Christopher at Audi Canada and he says my issues made it all the way to the CEO level of Audi and my case has been denied due to “missed opportunities” at the dealer level. All the executives and CEO decided that the dealer did not follow proper procedure, and I need to contact the dealer to see if they are willing to help. My car has no engine and is in numerous boxes spread across the shop! I explained the paperwork is not my issue, that’s between Audi and the dealer, not me and Audi.

Called the dealer back and they are going to see what they can do for me on the car. The dealer is willing to help me, but we need to make sure this is a permanent fix and I’m not back in a few months again.

Will have to send legal letter to Audi Canada, I am going to look into renting an advertising sign by the Audi offices...

This problem is causing me serious stress! I think I may have anxiety now or some kinda hyperventilation issue.

My ViewPoint

I’m not sure how else to look at this other than Audi is trying to get out of paying for an expensive problem. My service records show the problem started at 41k in 2007 while the car was under warranty. This is a known issue with these 4.2 engines and if you do a search on the web to some of the forums, you’ll see other similar problems. An Audi S4 retails for over $70k cdn new, I think it’s a reasonable expectation that your car should work properly and the warranty should be honoured even if the parts are expensive. I am not asking for anything extra, I want what is owed to me and that’s a manufacturer’s warranty. Audi has tried everything to get out of this issue, including telling me I could have my extended CPO warranty moved to my name until the problem occurred. Once the car needed a new engine suddenly there was a policy change 28 days before my car was registered and the warranty could not be moved! If you read the service reports and my posts you’ll see that facts show the car had a problem from very early in its life.
If Audi has an issue with the dealer and how the paper work was completed why put me in the middle? Why the hassle, I love my car and fell in love with it after driving it, just too bad Audi does not believe in standing behind there products and try to point the finger at everybody else. The dealer didn’t make the defective engine, my car was regularly serviced, I didn’t cause this problem. I wanted to buy another Audi and was thinking of an RS4, but with all these problems why would I? Why would I encourage anybody else to buy one? This has been experiences dealing with Audi Canada; it seems they are too busy trying to save money rather that customer satisfaction. Can somebody tell me how with all this evidence you could legitimately refuse warranty?
To summarize:
- Car has extended warranty to 2011 and 160,000kms paid for, but in previous owner’s name.
- Problem reported at 41,000kms in 2007 while under basic manufacturers warranty.
- Engine removed twice.
- Car has been sitting with no engine for 6 weeks.
- At week 4 car was broken into and Navi unit stolen while at dealer with no engine, battery and alarm.
- Other 4.2 Audi engines have same problem with no solution.
- Audi says car out of warranty because severity of problem was discovered at 80,700Kms (700 kms over warranty).

Time Log for time wasted dealing with Audi Canada

21-May-2009
Called Christopher through main number and call centre rep told me he was not available but would get him to call me back.
Rep called back to say Christopher not in the office today, will have to wait till tomorrow.
Advised attorney to wait on sending letter till we hear back from Audi Canada, if warranty is denied then this is only recourse.

20-May-2009
Christopher called and left me a message saying that if I am going to pursue legal action, he needs to talk with me. I tried calling him back but he was gone for the day, rep on phone says if I pursue legal route I will have to deal with another group.
I guess attorney called Audi Canada and was asking questions about my case and how to fax letter, Audi Canada does not provide fax numbers or any information.
This call centre is a really frustrating experience; it doesn’t seem to be in place to really help people with problems, just to frustrate people until you go away.

19-May-2009
Called Christopher through main number and call centre rep told me he was not available but would get him to call me back. He has not called back even though he said he would and I still have no direct number to him. He says he is exclusively dealing with my case but i have no way to get to him directly
Sent service history and car information to attorney just in case Audi denies warranty, attorney drafting a letter, may have to take them to small claims court. Not my preference since it will take an extended period of time and will not have a car anymore, as I imagine dealer will take back loaner.

15-May-2009
Called Christopher but could not get him, advised by call centre he will call me back. Christopher calls back and says he has not been informed of any decision and will call me back Monday or Wednesday with more information.

13-May-2009
Christopher the supervisor from Audi calls me back and leaves a message, I try to call him back but only have main number. Leave a message for him to call me back.

8-May-2009
Went to dealer, service manager told me Audi is going to review issue internally and they are waiting for a decision from Audi before sending engine out for work.

07-May-2009
Went to dealer and they said they are going to help me out of there own pockets. They are going to send engine to machine shop to find problem and re-ring. Dealer very nice, swapped my courtesy car and gave me another 2009 A4 without winter tires. Waiting for Audi to call dealer, dealer thinks car should be ready in 2 weeks.Have concern because if problem not solved how can I get warranty, need Audi to accept responsibility.

Dealer moved car inside shop for better security

06-May-2009
Call Audi again and spoke to a very nice representative and she listened and seemed very kind. She is offering to escalate but says outcome will not change but she will try to help me.

04-May-2009
Called Audi again they are reviewing.Got a call back from a Audi representative that says car not under warranty and I need to sort it out for myself, also say extended warranty not applicable because the policy changed. Asked what to do because car has no engine, rep told me to call dealer, not Audi Canada’s problem and she is sorry my car was broken into. Rep explained car registered Aug 29 2006 and policy allowing you to change registration changed Aug 1st 2006. Soooooo car has no warranty and I am out of luck.Treated by Audi Canada very poorly like car is worth 10 bucks and I need to deal with it myself, rep has no empathy or concern for me as a customer. Asked for manager and she reluctantly escalated my call but says manager will tell me same thing she did.

30-Apr-2009
Audi Canada says car out of warranty because last repair car was brought back over 80,000kms, even though car brought in at 79k and problem documented from 41k. They are sorry for my loss of my stereo, say to contact dealer. Dealer working to find a solution, I have had a loaner for 4 weeks now, feel bad for dealer.

29-Apr-2009
Called Audi help line for assistance, they say they will review the claim. Car should have extended warranty to 160,000Kms or 2011.
Dealer agreed to pay for stereo and repair damage to car.

28-Apr-2009
Called Audi dealer to notify that winter tires on loaner to see if they want me to bring back car and get one with summers. Found out car has been broken into, somebody threw a piece of steel through car window and stole stereo system! Car has no engine or battery connected, has been sitting outside for 4 weeks waiting for Audi to respond. Found out from dealer Audi says car outside of warranty and have denied warranty, want dealer to pay for part themselves. Called cops and filled out police report, approximately $6k worth of stereo stolen, seat damaged, and window broken. Car now has a garbage bag for a window, really nice to have your luxury car smashed with no engine.

8-Apr-2009 Dropped my car off for warranty repair to have engine repaired under warranty because of excessive oil use. Dropped car at dealer, this is the second time motor has been out of the car. This should be a happy day since car is finally being repaired!

Audi removes engine from car again, this time takes down to bottom end and finds some internal motor issues. Audi recommends car have new short block installed, this part costs approx 12k cdn. Estimate will have car back in 2 weeks.

11-Feb-2009
91,840Km’sCar back at dealer for oil use again! Dealer removed engine at request of Audi, saw lots of oil residue in cylinders, car compression tests low on 7 of 8 cylinders. Audi suggest replacing PCV valve again, cleaning engine and reassembling! Car will be back for same problem again. Dealer is trying to help me but hands are tied by Audi Canada.

28-Jan-2009
90,770Km’s
Guess what oil light back on, car has taken 2 litres of oil, dealer ads 2L of oil again to car.

28-July-2008 79,097Kms
Car back at Audi to verify oil problem, Audi has changed policy and oil needs to be weighed not measured dealer has weighed the oil and have to drive car for 1000K. Car has8.40Kg of oil

09-May-2008
72,547Km’s
Car back at dealer for oil use problem again, marked dipstick and must bring car back to dealer to verify.

17-Sep-2007
54,461Km’s
Oil light on again, dealer topped up by adding 1litre, light out.

22-Aug-2007
Brought car back to dealer to check oil use with 51,986kms, some residue on cats that may be from tranny vent, dealer added dye to oil. Must bring car back again in 1000kms to verify.

17-Aug-2007
Driving Car to Montana and oil light came on just as leaving city, advised car holds 8 litres of oil so not to worry. Added 1 litre of oil in Great Falls after about 500kms of driving (light went out), oil light came back on in Bozeman, car has oil residue all over back bumper. Added more oil to car and called dealer to schedule appointment.

04-July-2007
44,552Km’s
Brought Car back in again because oil light is back on, told that this is within parameters of Audi for that engine. Car can use 500ml or 1/2 Quart of oil every 1000kms.

1-June-2007
41,992Km’s
Dropped car off at Audi dealer for service and complain that car uses oil excessively; oil light comes on every 4 to 5 tanks of fuel. Car has 2 years and 40,000kms left on manufacturer’s warranty.
